What is the content of the training?

 

In the training, the situations in which the employer can agree with their employee on a non-competition period extending after the end of the employment relationship are thoroughly reviewed. During the training, you will get to know valid legal practice, based on which the situations where the employer can be considered to have a particularly compelling reason for concluding a non-competition agreement with its employee as required by the Employment Contracts Act will be illustrated. The training will also cover the employer's obligation to compensate the employee for the period of restriction under the non-compete clause.

 

The training answers, among other things, the following questions:

  • What is stipulated in the Employment Contracts Act about non-competition?
  • What is considered a competitive activity?
  • How are different factors taken into account in the evaluation of a particularly compelling reason?
  • What is the importance of the quality of the employer's operations in terms of the non-compete agreement?
  • What is the importance of maintaining the employer's customer base in terms of the non-compete agreement?
  • What is the importance of keeping the employer's trade secrets in terms of the non-compete agreement?
  • What is the significance of the employee's position and tasks in terms of the non-compete agreement?
  • What kind of compensation must the employer pay the employee for the limitation period of the non-compete?
  • Can the employer terminate the concluded non-competition agreement, and with what notice period?

 

What do you learn from the training?

 

After the training, you will know the conditions under which an employer can enter into a valid non-compete agreement with their employee, what the non-compete agreement is worth and can agree on, how long the non-compete agreement can be valid and what kind of compensation must be paid to the employee for the limitation period according to the non-compete agreement, and whether the non-compete agreement can be terminated during the employment relationship.

The training is designed for company managers, supervisors and HR experts, regardless of the person's role and the company's industry.

 

How can thtraining be organized and what does it cost?

 

You can order the training to be organized at your company's location. The training can also be organized remotely as a Teams meeting or in a space organized by Folks.

 

The price of the training is agreed on a case-by-case basis with each customer, taking into account, among other things, the scope and duration of the training and the number of participants in the training. For example, a three-hour training in the capital region without restrictions on the number of participants is 1,300 euros (+ VAT 24%). The price of the training includes the electronic material distributed to the participants.
